Terms of Service

Please read these Terms of Service ("Terms") carefully before using the SmartNex.ai website (the "Service") and its associated mobile applications ("Apps") operated by SmartNex.ai ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

2. Description of Service

SmartNex.ai provides a multi-tenant SaaS platform for managing properties, particularly PGs, messes, and colleges. The Service includes a web dashboard for Super Admins, a mobile app for Admins ("PG Owners"), and a mobile app for Tenants.

3. User Accounts

• Admins ("PG Owners"): You are responsible for all activity that occurs under your account. You are also responsible for the data of your Tenants that you manage through our Service, including setting and collecting rent.
• Tenants: Your account is created by an Admin. Your default password is your mobile number. You are responsible for changing this password upon your first login. You agree to provide accurate payment information and proof when requested.

4. Payments

• SmartNex.ai is a platform and a facilitator of payments. We are not a party to any transaction between an Admin and a Tenant.
• Admins: are responsible for setting up their own third-party payment gateway accounts (e.g., Razorpay) and for all disputes, refunds, and chargebacks.
• Tenants: agree to pay their rent as specified by their Admin. For manual UPI/Cash payments, you agree that a payment is only considered "Paid" after the Admin has approved your submission.

5. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

6. Disclaimer of Warranties

Our Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, that the service will be uninterrupted, error-free, or secure.

7. Limitation of Liability

In no event shall SmartNex.ai, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
